RE: The tariff classification of an electric motor and timer combination from China

Dear Mr. Des Champs:

In your letter dated September 25, 2012, you requested a tariff classification ruling.

The article concerned is an electric motor and timer combination. The motor is a single phase, 370 watt, 110/220 volt AC electric motor. The timer is a low voltage timer that is wired directly (plugs into) to the electric motor. The timer is used to run the motor for specific intervals of time (either 15 or 30 minutes). The timer operates electronically; it does not incorporate any moving parts. Both items will ship together in the same box. The timer and electric motor are used to operate a stackable paint mixing machine.

The item concerned is a composite good consisting of different components. Therefore, its classification must be determined in accordance with General Rule of Interpretation (GRI) 3(b), which states in part, that composite goods made up of different components, shall be classified as if they consisted of the component which gives them their essential character. Based on the information supplied the essential character of this good is imparted by the electric motor.

The applicable subheading for the electric motor and timer combination will be 8501.40.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Electric motors …: Other AC motors, single-phase: Of an output exceeding 74.6 W but not exceeding 735 W: Other". The rate of duty will be 4%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
